CHD Disappointed by D.C. Circuit Panel OTARD Decision
Washington, D.C., Feb. 15, 2022 (GLOBE NEWSWIRE) — On Friday, Feb. 11 a panel of the Court of Appeals for the D.C. Circuit denied a petition for review submitted by Children’s Health Defense and four families that challenged a 2020 FCC rule, Over the Air Reception Devices (OTARD). OTARD allows private wireless Internet providers to contract with a property owner and install antennas that provide Internet access to the local area without any notice or right to object by people opposed to the project. OTARD also preempts local zoning laws, deed and other property restrictions on wireless deployment. The FCC rule strips all remedies granted by any state law that “restricts” deployment of private carrier Internet facilities.
CHD Points Out Potential Human Health Risks From 5G Rollout
Washington, DC, Jan. 24, 2022 — Last week, several international airlines cancelled flights to the U.S. following Verizon’s and AT&T’s rollout of 5G. Dubai’s Emirates Airlines suspended flights to major cities including Boston, Chicago, Dallas, Houston, Miami, Newark, Orlando, San Francisco and Seattle. In a CNN interview, the president of Emirates Airlines stated that the deployment of 5G is “one of the most delinquent, utterly irresponsible issue, subjects, call it what you like, I’ve seen in my aviation career.”

Employees at France’s Biggest Phone Company Undermine Country’s 5G Push
Employees at Orange, France’s biggest phone company and the tenth largest mobile network operator in the world, are calling for management to stop the rollout of 5G just days before the industry plans to commit billions to their deployment in the country. About 1,000 Orange employees, calling themselves “Je Suis Si Vert” (I’m So Green), circulated two memos. The most recent memo — Without 5G: Orange in The Future World — from May 2020, argues that 5G will be bad for the environment and unprofitable.
5G “Small Cell” Proliferation Takes a Hit in Cambridge MA
In an important win for those who are concerned about 5G and small cell wireless proliferation, on August 26, 2020 the U.S. District Court for the District of Massachusetts dismissed a lawsuit by “neutral host” provider ExteNet Systems, Inc. against the City of Cambridge, MA.
The case could have far-reaching impacts when “neutral host providers” like American Tower, Crown Castle and ExteNet try to secure approval to occupy municipal rights-of-way. Neutral host providers build wireless infrastructure and then lease space to the wireless companies (like AT&T, T-Mobile and Verizon) that provide the wireless service.
ExteNet filed several applications in Cambridge to replace utility light poles with new ones that housed equipment to be leased to AT&T. AT&T, not ExteNet, would supply the fiber connections and electric power. Cambridge’s Pole and Conduit Siting Policy requires applicants working on a proposed project with other companies to designate a lead company for the application.
Hawaii’s Big Island Called Upon Telecom to Cease and Desist 5G Deployment
A resolution to cease the buildout of 5G wireless infrastructure until it can be proven safe, through independent research and testing, passed the Hawaii County Council on July 22, 2020, almost unanimously. The vote was 8-1.
The resolution, introduced by council member Matt Kaneali’i-Kleinfelder, came to the table after months of daily emails and phone calls from constituents regarding 5G. “There was overwhelming public concern,” he said. The resolution was put forth by constituents and Kaneali’i-Kleinfelder agreed to present it to the council.

Costa Mesa, CA just approved “small” cell towers to be built 30 feet from home daycares. Within days residents are reporting headaches, nose bleeds, fatigue, behavioral issues, and tinnitus. These symptoms are just the beginning. Studies from different countries show up to a 200% increase in cancer within 1500 feet from a cell tower.
Maine Resident with Cancer Sues Over Discriminatory Smart Meter Opt-Out Fees
On July 9, 2020 Maine resident Ed Friedman filed a disability/discrimination lawsuit against Central Maine Power (CMP) in Portland’s U.S. District Court (a Federal Court). The suit, brought under the Americans with Disabilities Act (ADA), Fair Housing Act (FHA) and Rehabilitation Act of 1973 (Rehab Act) alleges smart meters’ opt-out fees are discriminatory to those disabled customers whose condition may be exacerbated by radiation emitted from the smart meters. Friedman has lymphoplasmacytic lymphoma, an incurable form of cancer.
In the past 10 years, utility companies have been replacing electric, gas and water analog meters with wireless pulsed and radiation emitting “smart” meters. These meters are the first devices that have been rolled out as part of the “smart” grid and the “Internet of Things” infrastructure. They have been installed on people’s homes generally with few details and usually without express consent.
Easton, CT, Calls upon Telecom to Cease and Desist 5G Deployment

People have been on lockdown for the past 2 months, but one freight train that has not been halted by COVID-19 is the fast and furious installation of 4G/5G small cells across the state, including in residential neighborhoods. However, one small town in Fairfield County, Easton, recently decided to try and put the brakes on the 5G rollout. On May 7, 2020, the Easton Board of Selectmen unanimously approved a 5G cease and desist resolution “until such technologies have been proven safe to human health and the environment through independent research and testing.”
What You Should Know About 5G Satellites — How Musk’s Sci-Fi Dreams Are Becoming Our Living Nightmare
Companies and governments have plans to launch approximately 50,000 satellites to provide 5G and Wi-Fi services everywhere on Earth. Elon Musk’s SpaceX is leading these efforts with its planned deployment of 42,000 Starlink satellites and its goal of establishing a global network.
To provide service, SpaceX states that it requires an infrastructure of one million on-the-ground antennas to connect its satellites with the ground users. In March 2020, the Federal Communications Commission (FCC) approved SpaceX’s ground antenna application. On 7/31/2020, SpaceX modified its original filing and has asked the FCC to increase this number to five million. Almost 400 satellites have been launched to date.
5G AirGig: What is It and Should You Be Worried?
AirGig is a new technology developed by AT&T to transfer Wi-Fi and wireless data over power lines using 4G LTE and 5G millimeter waves. To date, AT&T has submitted over 500 patents and applications related to the AirGig technology, which turns existing power lines into transmitters. According to AT&T’s glowing press releases, AirGig could even replace cell towers:
“We hope that one day there will be no need to build new towers or bury new cables in locations close to aerial power lines. Instead, using AirGig patented technology, we would install devices to provide high speed broadband which can be clamped on by trained electrical workers in just a few minutes.”
Seeking Justice Around the Globe: Lawsuit to Stop 5G Filed in the Netherlands
The Dutch stop 5G group, Stop5GNetherlands, filed an injunction against the Dutch State on Feb. 25, 2020, invoking an emergency procedure to stop the rollout of 5G. This lawsuit is joining a growing body of litigation against governments around the globe, including the Children’s Health Defense lawsuit in the US, to protect the health of their citizens, the wildlife and their natural habitat from the proven harms of wireless technology radiation, and now, 5G.

Robert F. Kennedy Jr.’s Children’s Health Defense Submitted Historic Case Against U.S. Government for Wireless Harms
WASHINGTON, Feb. 3, 2020 — Children’s Health Defense (CHD) is leading a historic legal action against the Federal Communication Commission (FCC) for its refusal to review its 25-year-old guidelines, and to promulgate scientific, human evidence-based radio frequency (RF) emissions rules that adequately protect public health from wireless technology radiation. The Petition contends the agency’s actions are capricious and not evidence-based. The petition was filed on 2/2/2020 in the U.S. Court of Appeals for the 9th Circuit.
Robert Kennedy Jr.’s Legal Team Sues FCC Over Wireless Health Guidelines
Robert Kennedy Jr., chairman of Children’s Health Defense (CHD), is committed to be proactive on the concerns regarding excessive exposure of our children to 5G and wireless radiation. To fulfill this promise, CHD submitted a lawsuit on Feb. 2, 2020 against the FCC for its Dec. 4, 2019 decision to decline to review its 1996 guidelines, and for its determination that the guidelines are protective of human health.
The Dec. 4 determination provides a rare opportunity to sue the FCC and expose its disregard for public health that has been causing so many injuries and deaths, including among children. We will be representing the many children who have been injured. This is the opportunity we have been waiting for; a successful lawsuit on this will be a game changer.
Six Italian Courts Have Ruled Cell Phones Cause Brain Tumors
On Jan. 13, 2020, Turin’s Court of Appeals confirmed a 2017 decision determining that a former Telecom Italia worker’s acoustic neuroma (a benign tumor in the ear) was caused by his mobile phone use. This is the sixth time that an Italian court has affirmed a causal link between cell phone use and brain tumors, including decisions by the High Court of Italy.
The Appellate court reached its decision after a review of the evidence and after receiving the opinion of two court-appointed experts. The experts referred the court to studies indicating that individuals who speak on their phones for an average of 30 minutes a day for at least 10 years increase their risk of developing head tumors.
5G and Wireless Technology Health Effects
I was invited to give a short presentation on 5G & Wireless Technology health effects to the Beverly Hill’s City Council. Seventy years of science, including thousands of studies showing clear evidence of harm, the human evidence and the evidence of fraud, cannot be conveyed in 15 minutes. As an experienced telecommunication and computers’ officer who understands the technology, as an attorney trained to evaluate evidence, and has actually litigated this issue in the Israeli Supreme Court, and as an advocate who is working daily with adults and many children who have become sick, there is no doubt – the evidence of adverse health effects from wireless technology, including from cell phones, Wi-Fi, wireless “smart” utility meters and cell towers is conclusive.
5G – Global Human Experiment Without Consent
5G is the next generation of cell phone infrastructure, yet it is categorically different than its predecessors (4G/LTE, 3G, 2G, etc.). It is not a simple upgrade. It is a major increase – and change – in the type of wireless radiation to which we will all be exposed, without consent, whether we use this service or not.
5G builds on existing infrastructure and, in addition, uses extremely high (millimeter-wave) frequencies of 24 gigahertz (GHz) or more. These 5G signals don’t travel far, so antennas will be installed approximately every 2-10 homes in residential neighborhoods. 5G will significantly increase our wireless RF radiation (radio frequency microwave) exposure on a 24/7 and 365 days a year basis.
5G: Coming to a Lamppost Near You
5G is the latest development in wireless communication. We’re promised faster Internet with greater capacity.
Thousands of experimental licenses have already been handed out around the world. The UK lined up Chinese company Huawei to bring us the new technology but this proved highly controversial. UK security chiefs have expressed concern that the 5G networks could enable cyber attacks and espionage. Governments in Australia, New Zealand and the U.S. have already blocked Huawei apparently due to similar fears.

5G From Space
In November of 2018, the U.S. Federal Communications Commission (FCC) authorized the rocket company SpaceX, owned by the entrepreneur Elon Musk, to launch a fleet of 7,518 satellites to complete SpaceX’s ambitious scheme to provide global satellite broadband services to every corner of the Earth.
The satellites will operate at a height of approximately 210 miles, and irradiate the Earth with extremely high frequencies between 37.5 GHz and 42 GHz. This fleet will be in addition to a smaller SpaceX fleet of 4,425 satellites, already authorized earlier in the year by the FCC, which will orbit the Earth at a height of approximately 750 miles and is set to bathe us in frequencies between 12 GHz and 30 GHz. The grand total of SpaceX satellites is thus projected to reach just under 12,000.
The Dangers of 5G to Children’s Health
Mobile and wireless technologies are a ubiquitous feature of modern life. Most U.S. adults own smartphones, a growing proportion are “smartphone-only” Internet users and over a fourth report being online “almost constantly.” As for children, a 2014 survey of high-income nations reported that almost seven in ten children used a mobile phone, and two-thirds of those had a smartphone, usually by age 10. As described by Nielsen, it is now as common to see “a kid with a smartphone in their hand” as it was to see “a kid playing with a yo-yo in the years before the digital age.”

The Inconvenient Truth About Cancer and Mobile Phones
On 28 March this year, the scientific peer review of a landmark United States government study concluded that there is “clear evidence” that radiation from mobile phones causes cancer, specifically, a heart tissue cancer in rats that is too rare to be explained as random occurrence.
Eleven independent scientists spent three days at Research Triangle Park, North Carolina, discussing the study, which was done by the National Toxicology Program of the US Department of Health and Human Services and ranks among the largest conducted of the health effects of mobile phone radiation. NTP scientists had exposed thousands of rats and mice (whose biological similarities to humans make them useful indicators of human health risks) to doses of radiation equivalent to an average mobile user’s lifetime exposure.
