Arizona Becomes First State to Sue Biden Administration Over COVID-19 Vaccine Mandates

Arizona’s attorney general filed a lawsuit Tuesday that seeks to invalidate President Biden’s latest COVID-19 vaccine requirements for federal workers and large companies, becoming the first state to mount a legal challenge to the administration’s newest rules.

In a 14-page complaint filed with a federal district court in Arizona, Attorney General Mark Brnovich argued Mr. Biden’s new vaccine requirements unconstitutionally discriminate against U.S. citizens because undocumented immigrants apprehended by federal law enforcement are not subject to a federal vaccination requirement.

While the details of the policies are still being worked out and yet to be made public, the attorney general said they are an “egregious” violation of the Constitution’s Equal Protection Clause.

Judges Temporarily Block Vaccine Mandates for NYC Teachers, NY Medical Workers

Two court rulings on Tuesday could have big impacts on New York vaccine mandates.

Mayor Bill de Blasio on Aug. 23 ordered New York City public school teachers and staff must get vaccinated for the new academic year.

The city’s mandate said the Department of Education employees had until Sept. 27 to get at least one dose of the vaccine.

New York Supreme Court Judge Laurence Love on Tuesday issued a restraining order against the mayor’s mandate, temporarily blocking the city from enforcing it. The ruling came after several municipal unions sued the city.

One was in the form of a new bill heading to the House of Representatives (asking for all plane and train travelers in the U.S. to show proof of their COVID-19 health status) and the other was from Dr Fauci, declaring his support for banning unvaccinated Americans from flying.

Indeed, it has been reported that the White House is only considering reopening travel up to EU and U.K. travelers if people can show proof of vaccination.

Questions Linger on Vaccine Mandate for Federal Contractors

Contracting experts have additional questions about the vaccine mandate for federal contractors ahead of the supplemental guidance expected to be released later this month.

President Biden issued an executive order on September 9 requiring federal contractors, as well as federal employees, to be vaccinated against the novel coronavirus. The order outlines what should be implemented over the next month and how, but the Safer Federal Workforce Task Force will issue supplemental guidance by September 24 that will further explain the requirements and any exceptions.

U.S. Citizens Are Disgruntled by Extent of State Surveillance at Home

The U.S. surveillance on its citizens is common knowledge yet the way the U.S. government goes about spying and how it uses its surveillance data against the ones it targets is controversial.

A poll carried out in mid August has found that more Americans were against the government’s intrusive surveillance programs than ever before.

The poll was conducted by the Associated Press NORC centre for public affairs research with over 1700 American adults participating.

According to the poll 46% of Americans say that they oppose the U.S. government responding to threats against the nation by reading emails sent between people outside of the US without a warrant.

U.N. Urges Moratorium on Use of AI That Imperils Human Rights

The U.N. human rights chief is calling for a moratorium on the use of artificial intelligence technology that poses a serious risk to human rights, including face-scanning systems that track people in public spaces.

Michelle Bachelet, the U.N. High Commissioner for Human Rights, also said Wednesday that countries should expressly ban AI applications which don’t comply with international human rights law.

Applications that should be prohibited include government “social scoring” systems that judge people based on their behavior and certain AI-based tools that categorize people into clusters such as by ethnicity or gender.

AI-based technologies can be a force for good but they can also “have negative, even catastrophic, effects if they are used without sufficient regard to how they affect people’s human rights,” Bachelet said in a statement.

Thousands of State Workers Seek Exemptions to Washington Vaccine Mandate

Workers must be fully vaccinated by Oct. 18, or lose their jobs unless they have either a medical or religious exemption.

More than 4,300 state workers are seeking an exemption to Washington Gov. Jay Inslee’s COVID-19 vaccine mandate. That’s about 7% of the approximately 60,000 employees subject to the requirement.

The U.S. Makes Coronavirus Vaccinations Mandatory for New Immigrants

Beginning Oct. 1, new immigrants to the United States must be fully vaccinated against COVID-19, the U.S. Citizenship and Immigration Services said in a news release on Tuesday.

People seeking to become “lawful permanent residents” — or green card holders — have permission to live in the United States and eventually seek citizenship. Applicants for permanent residency must undergo a medical examination.

The new requirement for those seeking permanent U.S. residency is in line with President Biden’s new vaccine mandates for federal workers and contractors. The Pentagon has announced that active-duty military personnel also must be vaccinated.

California Sheriff Refuses to Enforce Vaccine Mandate, Says Government Lacks ‘Authority’

A California sheriff said he will not enforce any vaccine mandate on employees of his department, citing the government having “no authority to mandate your health choices.”

“Over the past couple of weeks, the idea of forced vaccination has caused much concern across the entire country,” Riverside County Sheriff Chad Bianco said in a statement released Monday. “I will not enforce the vaccine mandate on Sheriff’s Department employees.”

“The government has no ability and no authority to mandate your health choices,” he said. “As your sheriff, I have an obligation to guard your liberty and freedom.”

A federal judge temporarily blocked the state of New York on Tuesday from forcing medical workers to be vaccinated after a group of healthcare workers sued, saying their Constitutional rights were violated because the state’s mandate disallowed religious exemptions.

Judge David Hurd in Utica issued the order after 17 health professionals, including doctors and nurses, claimed in a lawsuit Monday that their rights were violated with a vaccine mandate that disallowed the exemptions.

The judge gave New York state until Sept. 22 to respond to the lawsuit in federal court in Utica.

The state issued the order Aug. 28, requiring at least a first shot for health care workers at hospitals and nursing homes by Sept. 27.

Schools Will Need Vaccine Mandates for In-Person Classes to Last, Expert Says

As COVID-19 cases surge among children, vaccine mandates in schools might become the only way to keep kids learning safely in classrooms, a pediatrician said.

“So far, we’ve not seen a lot of COVID vaccine mandates, even for the teenagers,” said pediatrician and vaccinologist Dr. Peter Hotez, dean of the National School of Tropical Medicine at Baylor College of Medicine.

“It’s gonna have to happen if we’re going to get kids through the school year.”

Federal Appeals Court Denies IU Request to Dismiss COVID-19 Vaccine Mandate Lawsuit

The Seventh Circuit Court of Appeals denied Indiana University’s motion to dismiss a lawsuit over its COVID-19 vaccine mandate.

IU argued that, since school has already begun and the students challenging its mandate had received exemptions or withdrawn from IU, they no longer had standing to bring the case.

“Today’s ruling allows this fight to continue for the Students and that they will have their constitutional claims decided on the merits” said James Bopp, Jr., of The Bopp Law Firm.

Bopp said the two students IU claimed withdrew from the university only deferred their attendance, pending the final outcome of the lawsuit.

Amazon Brings Palm-Swiping Tech to Red Rocks Concert Venue

The Associated Press reported:

Amazon says it is bringing its palm-recognition technology to the Red Rocks Amphitheatre in Denver and it will be available at other venues in the coming months. It’s the first time the technology, called Amazon One, will be used outside some of Amazon’s stores, where shoppers can pay for groceries and snacks by swiping their palms.

Starting Tuesday, concertgoers at Red Rocks can sign up to connect their palm to a ticketing account by hovering their hand over a device. They only need to sign up once and then can use their palm to get into other shows and events at the venue. An Amazon account is not needed to use it.

Amazon signed a deal with entertainment company AEG to bring the technology to Red Rocks, which sells tickets on AEG’s ticketing site, AXS.

LAPD Employees File Federal Lawsuit, Challenging City’s COVID-19 Vaccine Mandate

A group of LAPD employees have filed a federal lawsuit, challenging the city’s COVID vaccine mandate.

“We are asking for two main things,” said Kevin Snider, chief council at the Pacific Justice Institute. “That those who had the coronavirus and have natural immunities be exempted from this ridiculous rule, and second is that people who have faith convictions against taking a vaccination need to have a meaningful process of more than 72 hours to submit their request for religious accommodations.”

The lawsuit was filed over the weekend in federal court by six Los Angeles Police Department workers, according to the Los Angeles Times. It claims that the mandate violates their constitutional rights to privacy and due process.

GOP Condemnation of Biden Coronavirus Mandate Fuels Concern Other Vaccine Requirements Could Be Targeted

Republicans’ sweeping denunciations of President Biden’s plan to force more people to get vaccinated against the coronavirus are raising concerns among public health experts that this heated criticism could help fuel a broader rejection of other vaccine requirements, including those put in place by schools and the military, as the issue of inoculations becomes increasingly political.

Over the weekend, House Minority Leader Kevin McCarthy (R-Calif.) declared on Twitter that there should be “NO VACCINE MANDATES.”

More than a dozen other prominent Republicans in Congress and in the states have made similarly defiant statements in recent days, often using inflammatory rhetoric. In South Carolina, Gov. Henry McMaster pledged to fight Biden and Democrats “to the gates of hell” on coronavirus vaccine mandates, while Rep. Elise Stefanik (N.Y.) condemned Biden’s recent mandate as “authoritarian” and the work of “a power hungry government.”

MTA Yanks $500K COVID Death Benefit From Unvaccinated Transit Workers

Struggling to get its workforce vaccinated, the MTA has pulled a $500,000 death benefit for any unvaccinated employees who succumb to COVID, THE CITY has learned.

The MTA this week will extend through the end of the year the lump-sum payment and three years of health insurance to the survivors of vaccinated workers who die from the virus, a senior official said.

But workers who opt out of getting their shots could relinquish the rights of their loved ones to secure the benefit should they die — unless they had a “valid documented exception” to vaccination, according to a notice sent to employees by Paul Fama, the MTA’s chief people officer.

Facebook’s facilities management firm has demanded the removal of a union activist leading a campaign against “impossible workloads” imposed on exhausted cleaners at the US tech giant’s London offices.

Emails seen by the Observer show JLL @ Facebook, which manages the social media firm’s London sites, asked Churchill Group, which employs the cleaners, to remove the workers’ elected union rep, Guillermo Camacho, from Facebook’s offices after he helped organise protests against a doubling of cleaning duties in July.

“The number of floors we have to clean has gone up from five to 12 [at Facebook’s offices on Brock Street]. But they haven’t brought in more staff. It’s impossible – I was having to come before my shift and leave late to get it done,” said Camacho. “It’s making us all really stressed and sick. That’s why we had to protest.”

At least six unvaccinated maternity staffers at Lewis County General Hospital have resigned in recent days, and seven others remain undecided on whether to get vaccinated, Gerald Cayer, chief executive officer of the Lewis County Health System, said at a Friday news conference. The staff shortage will result in the hospital being “unable to safely staff” the maternity department beginning Sept. 25, he said.

Surgeon General: U.S. to ‘Monitor’ Whether Vaccine Exemptions Being Used Properly

U.S. Surgeon General Dr. Vivek Murthy has advised that the Biden administration will “monitor” to ensure no one abuses COVID-19 vaccine exemptions.

President Biden last week announced a mandate that required any company with at least 100 employees to mandate its workforce. The only way to avoid the mandate is to claim an exemption on either religious or medical grounds.

Some critics argue that the exemptions allow for simple abuse, but Murthy insists the administration will ensure that does not happen.

It May Take ‘Many, Many’ More Vaccine Mandates to End the COVID-19 Pandemic, Fauci Says

Millions of Americans still need to get vaccinated to slow or stop the spread of COVID-19 and getting the pandemic under control could take “many, many” more vaccine mandates, Dr. Anthony Fauci said.

Fauci, the director of the National Institute of Allergy and Infectious Diseases, said if more people aren’t persuaded to get vaccinated by messaging from health officials and “trusted political messengers,” additional mandates from schools and businesses may be necessary.

“I believe that’s going to turn this around because I don’t think people are going to want to not go to work or not go to college … They’re going to do it,” Fauci told CNN’s Jen Christensen during an interview at the NLGJA, the Association of LGBTQ Journalists, convention Sunday. “You’d like to have them do it on a totally voluntary basis, but if that doesn’t work, you’ve got to go to the alternatives.”

Spectrum Health Workers Can Use Natural Immunity as Vaccine Mandate Exemption

Spectrum Health will grant temporary exemptions from its employee vaccine mandate to individuals who can prove they have naturally acquired immunity to COVID-19.

The west Michigan hospital system, which is in the process of merging with Southfield-based Beaumont Health, will grant an exemption to those who have a positive PCR or antigen test for COVID-19 plus a positive antibody test from within the past three months, the health system said in a statement Thursday.

The exemption, the first for a major health system in Michigan, was developed “as new research has emerged” on natural immunity.

“While we still recommend vaccination for people with prior COVID-19 infection, according to this new research, there is increasing evidence that natural infection affords protection from COVID-19 reinfection and severe symptoms for a period of time,” the statement said. “Current studies are not clear on how long natural immunity protects from reinfection.”

Fauci Says He Would Support Vaccine Requirements for Air Travel

Anthony Fauci said in a new interview that he would support vaccine requirements for air travel.

“I would support that, if you want to get on a plane and travel with other people that you should be vaccinated,” Fauci said during an interview with the Skimm’s “Skimm This” podcast, which was taped Friday and is set to be released Thursday.

Fauci’s backing of a travel vaccine mandate comes after Rep. Don Beyer (D-Va.) introduced a bill on Thursday that calls for all airline and train passengers in the U.S. to show proof of vaccination or a present negative COVID-19 test in order to travel.

Why Is Congress Exempt From the Biden COVID Vaccine Mandate?

President Joe Biden says all federal employees will have to be vaccinated and weekly tests are not an option to get out of taking the shot. But one big group of people who get paid out of the federal treasury won’t have to get vaccinated: Congress.

The thing to remember is that the president controls the executive branch of government but can’t tell the legislative branch what to do, so Congress can make its own rules about vaccine requirements.

House Speaker Nancy Pelosi said back in April there would not be a vaccine requirement for members of Congress and their staff.

What to Know About Religious Exemptions for the COVID-19 Vaccine

IndyStar reported:

As more and more workplaces and colleges require employees and students to be vaccinated, some Hoosiers are responding with an increasingly familiar refrain: It’s against my religion.

Ivy Tech Community College, for example, has received roughly 230 requests for religious exemptions since mandating the COVID-19 vaccine for certain students.

Employers in the area, such as Indiana University Health, Marion County Health Department, and Eli Lilly and Co. have also enforced vaccine mandates effective as soon as mid-September and as late as mid-November. For some of these businesses, religious and medical exemptions will be granted on an individual basis.

ESPN Reporter Steps Down Over Vaccine Requirements

ESPN reporter Allison Williams said she will be stepping down for the college football season after she decided to not receive the coronavirus vaccine.

In a statement posted to Twitter on Thursday, Williams said she decided to not get the COVID-19 vaccine while she and her husband are trying to conceive a second child.

“This was a deeply difficult decision to make and it’s not something I take lightly,” Williams said. “I understand vaccines have been essential in the effort to end this pandemic; however, taking the vaccine at this time is not in my best interest.”

Henry Ford Health System Workers Drop COVID-19 Vaccine Mandate Lawsuit

History and the law are on President Joe Biden’s side when it comes to coronavirus vaccine mandates, a medical historian and legal experts told the Free Press.

Although legal challenges are likely, “the mandates are legal and will ultimately be upheld,” said Peter Jacobson, professor emeritus of health law and policy at the University of Michigan, of the sweeping plan Biden announced Thursday to combat the pandemic.

The plan includes an emergency order through the U.S. Department of Labor’s Occupational Safety and Health Administration that will require as many as 100 million U.S. workers get coronavirus vaccines or submit to weekly testing.

Amid Cries of Tyranny, Britain Cancels Any Plan to Require Vaccine Passports

After months of cries of tyranny and discrimination raised by speculation that Britain would require vaccine passports for entry into crowded venues like stores and nightclubs, the authorities said on Sunday any such plans had been scrapped, at least for the moment.

Sajid Javid, Britain’s health secretary, said the passports —  essentially, documentation proving vaccination against COVID-19 — were still “a potential option” for the future. “It should be looked at in combination with other measures,” he told the BBC on Sunday.

Medicare App Flaw Means Vaccine Certificates Can Be Faked in Less Than 10 Minutes

A flaw has been discovered in the Express Plus Medicare app that allows people to fake their COVID vaccination certificates in under 10 minutes.

Once Australians get both doses of the COVID-19 vaccine, they are able to show a certificate on the app that includes their name, date of birth, and which vaccine they received.

The prime minister, Scott Morrison, last month described it as “a credible and effective and easily usable digital vaccination certificate which can be provided to Australians.”

The certificate has a digital animation behind it, which is designed to prevent people presenting fake versions, but Sydney software engineer Richard Nelson discovered he was able to exploit a security flaw in the app and provide it with fake vaccine information that looked identical to the real thing.

President Biden responded Friday to a pledge by some Republicans to sue over an incoming rule issued by the Labor Department requiring businesses with more than 100 employees to require that workers be vaccinated or undergo weekly testing.

Republican governors are slamming the president over the yet-to-be-developed rule, declaring it an overreach and unconstitutional. It’s the most sweeping vaccine mandate the federal government has yet announced.

“Have at it,” the president retorted during a school visit Friday morning when a reporter asked if the new requirements constitute overreach and could be confronted with legal challenges.

Manufacturers, Retailers Wary of Biden Private Sector Vaccine Mandate

Two powerful business groups, the National Association of Manufacturers and the National Retail Federation, stopped short of endorsing President Biden’s plan requiring large companies to mandate vaccinations on Thursday.

NAM, in a statement, was adamant in its support of nationwide vaccination efforts, though it indicated concern about the potential implications of Biden’s plan in the workplace. NAM President and CEO Jay Timmons asserted any requirement should be rolled out in a way that would not negatively impact operations.

“We look forward to working with the administration to ensure any vaccine requirements are structured in a way that does not negatively impact the operations of manufacturers that have been leading through the pandemic to keep Americans safe,” Timmons said in a statement. “It is important that undue compliance costs do not burden manufacturers, large and small alike.”

Biden Dangles New Federal Funds for Schools That Defy Mask Mandate Bans

On Thursday, President Biden announced a series of actions aimed at getting control of the surging pandemic. Alongside new vaccine requirements for private businesses, he announced new steps to encourage K-12 schools to mandate masks for all, require vaccines for employees and step up testing for COVID-19.

Coronavirus safety measures like these have become political flashpoints, and nowhere more than in schools. There have been violent confrontations at school board meetings over mask requirements, and states including Florida, Iowa, Oklahoma, South Carolina, Tennessee and Utah have all tried to stop districts from requiring masks. This comes as the highly contagious Delta variant is causing a rise in cases among young people, and those under 12 are still not eligible for vaccines.

TSA Doubles Fines for People Who Refuse to Wear Masks at Airports, in Other Transportation Settings

People who refuse to comply with a federal mandate that requires them to wear masks in airports, and on trains, buses and in other public transportation settings will face stiffer penalties, Biden administration officials announced Thursday.

Beginning Friday, the fine for refusing to wear a mask will increase to a range of $500 to $1,000 for first offenders. Penalties for a second offense will range from $1,000 to $3,000.

“TSA will double the fines on travelers that refuse to mask,” President Biden said Thursday. “If you break the rules, be prepared to pay. And by the way, show some respect!”

Medical Boards: Docs Who Spread COVID Misinformation Put License at Risk

Three primary care boards issued a joint statement today backing the Federation of State Medical Boards’ recent statement saying that if physicians spread misinformation about COVID-19, their medical license could be suspended or revoked.

Leaders of the American Board of Family Medicine (ABFM), the American Board of Internal Medicine (ABIM), and the American Board of Pediatrics (ABP) said they support FSMB’s position.

“We also want all physicians certified by our Boards to know that such unethical or unprofessional conduct may prompt their respective Board to take action that could put their certification at risk,” today’s statement read.

Americans Less Positive About Civil Liberties: AP-NORC Poll

Ten years after the 9/11 attacks, Americans were reasonably positive about the state of their rights and liberties. Today, after 20 years, not as much.

That’s according to a poll by The Associated Press-NORC Center for Public Affairs Research that builds on work conducted in 2011, one decade after the pivotal moment in U.S. history. Some questions were also asked on polls conducted in 2013 and 2015.

Americans were relatively united around the idea that the government did a good job protecting many basic rights a decade after the terrorist attacks, which produced a massive overhaul of the country’s intelligence services and the creation of agencies such as the Department of Homeland Security. Along with those changes came a creeping concern about government overreach, although Americans as a whole remained fairly positive.

That attitude has eroded in the years since, with far fewer people now saying the government is doing a good job protecting rights including the freedom of speech, the right to vote, the right to bear arms and others.

Los Angeles School Board Votes to Mandate COVID-19 Vaccines for Students 12 and Older

The Los Angeles Unified School District, the second-largest school district in the country, approved a COVID-19 vaccine mandate for students 12 and older on Thursday— one of the most aggressive measures taken by any school district to protect children.

Now, COVID vaccines will be mandatory for all eligible students by Thanksgiving if they want to attend in-person classes. The district has more than 600,000 students at more than 1,000 schools.

“When we look at other immunization requirements — polio, rubella, hepatitis — that we’ve had in schools for generations,  we are going to see other districts follow L.A. Unified’s lead,” said Nick Melvoin, a board member.

Big Tech Made Billions During ‘War on Terror’: Report

Tech giants made billions through contracts with the US military and other government agencies during the so-called “war on terror,” according to a report released ahead of the 20th anniversary of 9/11.

The “Big Tech Sells War” report, published Thursday by three US campaign groups, documented an explosion of government contracts with Amazon, Facebook, Google, Microsoft and Twitter since 2004.

The tech companies’ contracts were “primarily with agencies central to the War on Terror,” said the report.
