1. BIG WIN in Albany and NYC Lawsuit!
New York was able to prevent any vaccine-related bills from becoming law during the 2023 legislative session! This was a huge win and victory for New York and the country. The Defender published a full report on the achievement. CHD is back in court fighting for educators fired for declining COVID vaccination. Sujata Gibson argued for class certification on July 18 in NY State Supreme Court in Staten Island. Arguments were heard – awaiting a ruling. More details and updates.

2. CHD v. Rutgers
Appeals Court Heard Arguments Challenging Rutgers University COVID Vaccine Mandate in Case That Could Set National Precedent! On June 27, 2023, lead attorney Julio Gomez presented a fantastic oral argument in the appeal of the dismissal by the Federal District Court Judge. The hearing came after the U.S. District Court for the District of New Jersey in September 2022 dismissed a lawsuit filed in August 2021 by Children’s Health Defense against the university on behalf of 18 students challenging the university’s COVID-19 vaccine mandate. As of May 16, 2023, booster doses will no longer be required unless an individual falls within the “Covered Individual” definition outlined in University Policy 100.3.1.
Mr. Gomez acknowledged the presence of CHD members and community activists inside and outside the courthouse during the hearing. Members from the New Jersey and Pennsylvania chapters of CHD rallied in front of the US 3rd Circuit Court of Appeals to show their support for the student plaintiffs who oppose violating the right to informed consent and the right to refuse unwanted medical treatments.
