Tell the House: No Wireless Expansion Until the FCC Complies With Court Order

On January 14, the House Committee on Energy and Commerce’s Subcommittee on Communications and Technology will hold an FCC oversight hearing titled Oversight of the Federal Communications Commission. This hearing is a critical opportunity for lawmakers to hold the FCC accountable.
The FCC has still not complied with a 2021 federal court order (Envtl. Health Tr. v. FCC, 9 F.4th 893 (2021)) requiring it to review and update its radiofrequency (RF) exposure guidelines. Despite this ongoing noncompliance, the FCC continues to advance policies that would accelerate wireless expansion nationwide and further preempt state and local authority.
Congress should not allow additional wireless expansion while the FCC remains out of compliance with the court order. The House must use this oversight hearing to demand accountability and make clear that no new wireless rules, policies, or expansion efforts should move forward until the FCC completes the required review.
Tell House lawmakers to use this hearing to enforce the court order, protect communities, and ensure that public health, the environment, and local decision-making are not sidelined in the rush to expand wireless infrastructure.
