704 No More: Give Control of Cell Tower Placements Back to Local Authorities

Numerous studies show that cell towers emit harmful radiation, increase the risk of cancers and other health issues, and recommend that cell towers should not be placed near homes, schools, playgrounds, or recreational areas. But federal law preempts local authorities from regulating cell tower placements to protect their residents against these harms.
Namely, Section 704 of the Telecommunications Act of 1996 prohibits local authorities from denying cell tower applications based on health and environmental effects.
CHD believes that local authorities are best positioned to decide if a cell tower is constructed and where it is placed based on the unique concerns of their communities, including health and environmental concerns.
